General Terms and Conditions ("GTC")
ELECTRIC HORIZON FESTIVAL

1. General
These General Terms and Conditions apply between the holder of an admission ticket (hereinafter referred to as the "Visitor") and the organizer, BASEMENT UG, Carl-Theodor-Straße 7, 68723 Schwetzingen, Germany, represented by its Managing Director, Marcel Kästel (hereinafter referred to as the "Organizer").
By purchasing an admission ticket, the Visitor enters into an event contract with the Organizer and acquires the right to attend the event. Every Visitor acknowledges and accepts the rights and obligations set out in these General Terms and Conditions as well as the Event Regulations.

2. Tickets / Admission Tickets
Ticket purchases are binding. The return or exchange of tickets is excluded.
Tickets must be retained and, once validated at the entrance, are generally no longer transferable.
Furthermore, the Organizer generally agrees to the transfer of the right of admission to a third party before the ticket has been validated, unless:
-
the Visitor is on the guest list; guest list tickets are and remain personalized;
-
the third party is subject to a venue ban;
-
the admission right is offered for sale at a price higher than the face value of the ticket;
-
the ticket is resold commercially or for business purposes;
-
the sale is brokered, carried out or processed by unauthorized third parties, in particular unauthorized internet service providers, online marketplaces or ticket resale platforms; or
-
the transfer is directly or indirectly connected with advertising measures, unauthorized travel packages, promotional giveaways or competitions.
Any Visitor who offers or transfers admission tickets in violation of the above conditions shall pay the Organizer an appropriate contractual penalty for each ticket or admission right offered in breach of these provisions. The amount of the contractual penalty shall be determined by the Organizer at its reasonable discretion. The Visitor may have the amount reviewed by a competent court for reasonableness.
In the event of a violation of the above provisions, the Organizer shall also be entitled to revoke the admission right and confiscate the ticket. This shall also apply if the ticket was acquired in good faith by a third party.

3. Cancellation or Interruption of the Festival; Program Changes
If the festival cannot take place or is cancelled due to the Corona pandemic / COVID-19 restrictions, the ticket will automatically remain valid for the next edition of the event.
The festival will generally take place regardless of weather conditions. However, if weather conditions pose a risk to the life, physical safety or health of visitors, artists or staff, the festival will be terminated immediately or temporarily suspended.
In such cases, as well as in the event of the festival being cancelled due to other cases of force majeure (including strikes or acute threats of terrorism, war or similar events), official orders or court decisions, there shall be no entitlement to a refund or compensation for damages unless the Organizer has acted with intent or gross negligence.
For safety reasons, the Organizer may temporarily or completely evacuate and close off individual areas of the festival site without giving rise to any claim for a partial refund of the ticket price.
Program changes may occur during the festival. In the event that individual artists cancel, the Organizer will endeavor to provide suitable replacements. Visitors shall have no claims against the Organizer due to the cancellation of individual artists.
In the event of program changes and/or the cancellation or removal of individual acts, Visitors shall have no claims against the Organizer provided that such changes remain within reasonable limits and the overall character of the festival is maintained.
Visitors must also accept delays or rescheduling of individual acts.
